Construction Contract Agreement
This agreement is executed on 18TH march, ............... between Er................................, having its Registered Office at.............., ................................................. acting through Shri ........................., (hereinafter called “the Contractor”), which term shall, unless repugnant to the context, include its legal representatives, of the one part and Client................. Ji(herein after called “the owner”), which term shall, unless the context otherwise admits, include his heirs, executors, administrators, legal representatives, nominees and assigns, of the other part.
WHEREAS the owner has
plot at Permanand Nagar, ..................... (as specified in Schedule I) duly
registered in name of his mother Smt. ................................................ the rights, title and
interest therein absolutely vested in her;
AND WHEREAS the owner
has requested the Contractor to build the House on ground floor, first floor
according to the plan approved by mutual consent; and as agreed by the
contractor with the specifications as mentioned in Schedule II and Schedule
III.
AND WHEREAS the Contractor,
has agreed to build the desired house(hereinafter called “the work”)
Now this AGREEMENT is
reduced into writing and respective parts thereof shall be performed by the
owner and the Contractor in accordance with the following terms and conditions:
Contracter of agreement
1.
The Contractor has agreed to complete the
work within 10 months from the date of commencement of work. The parties agree that the Contractor is
eligible for an extension of time under unforeseeable exceptional
circumstances, weather conditions or upon failure of owner to pay the amount
due at reasonable time. Extension of time will be agreed upon mutually.
2.
The
Contractor will carry out following item of work: -
a. Civil work:-
i. Excavation for
foundation in any type of soil and up to the depth recommended by the Architect
as and where needed.
ii. Structural members
like Column, beam, footing and reinforcement used as per structural design.
iii. Muroom/malma/Dust
filling with subbling within the plinth area and up to 2'6" depth plinth only.
iv. 4” base concreting
within the built-up area of the building.
v. 8” outer and 4”
partition wall and as necessary as per drawing.
vi. Single or double coat
of internal and external plaster as needed.
b. Finishing work:-
i. Installation of tiles
ii. Plumbing work
iii. Elecrtrical work
iv. Painting work
v. False ceiling
3.
The
Contractor has agreed to carry out the work at..................rs/sqft on ground floor,...................rs/sqft first floor,....................... rs/sqft of labour quarter, ............................rs/sqft for water tank
and Septic tank, ..................rs/rft for parapet wall, ...............................rs/rft for boundary wall upto
6’ height, ..............................rs/sqft for filling, subbling and base outside plinth.

It
is subject to the conditions and scope of work contained in schedule III. The
owner will pay to the Contractorthe amount mentioned in schedule IV as cost of labor
for construction and all other type of labor in the manner and at varying
stages of the construction as described in Schedule IV.
5.
Initially
the amount and payment schedule has been created as per drawing and the final payment shall be made as per actual
built up area on the site.
